Agreeing to these terms

These terms are an agreement between you and DreamSmith Labs, LLC. (“we”, “us”), which operates Hellodex. By creating an account or using the app, you agree to them and to our privacy policy. If you don’t agree, please don’t use Hellodex.

You must be at least 13 years old, or 16 in the EU and UK, to use Hellodex. If you’re under 18, a parent or guardian must agree to these terms for you.

Your account

• Use an email address you control and keep your password private. You’re responsible for what happens in your account.
• Tell us at support@dreamsmithlabs.com if you think someone else has accessed it.
• One person per account. Don’t create accounts for anyone else, or to get around a suspension or promo code limit.

Your contacts and content

You own the contacts, photos and notes you add (“your content”). You give us permission to store, copy and display your content only as needed to run Hellodex for you, including sending a contact to another user when you choose to share it. This permission ends when you delete the content or your account, except for copies you’ve already shared.

Your content is mostly about other people. You’re responsible for having a reasonable right to keep it, as you would in any address book, and for following the privacy laws that apply to you. Don’t save information that is unlawful, or that you obtained without permission, such as private details someone shared with you in confidence.

Using Hellodex responsibly

Please don’t:

• send unwanted bulk shares or invitations, or use Hellodex to harass, stalk or intimidate anyone;
• try to find out which email addresses have Hellodex accounts, beyond sharing with people you know;
• guess, sell or trade promo codes, or abuse free trials;
• access other people’s data, probe or bypass our security, or overload our systems;
• copy, modify or reverse engineer the app, except where the law allows it;
• use Hellodex for anything illegal.

Sharing with other users

When you share a contact, the recipient gets their own copy along with your email address. We can’t take back a copy once it’s shared, so share only with people you trust. Contacts others share with you are theirs to share; treat them with the same care.

Phone contacts and sync

Sync and “Save to phone contacts” change the address book on your phone at your request. Sync is designed never to delete contacts or clear fields, and it backs up a contact on your phone before changing it. Even so, your phone’s address book is ultimately your responsibility, so keep your usual backups (such as iCloud or Google) turned on.

Hellodex Pro subscriptions

• What’s included. Hellodex Pro lets you add new people, sync with your phone’s contacts, import from your phone and save contacts shared with you. Viewing, searching, editing and sharing what you’ve saved are free.
• Billing. Subscriptions are sold and billed by Apple (App Store) or Google (Google Play) to the account you use there. Prices are shown in the app before you buy and may vary by country.
• Automatic renewal. Your subscription renews at the end of each period at the then-current price unless you cancel at least 24 hours before it ends.
• Free trials. If a plan includes a free trial, it becomes a paid subscription when the trial ends unless you cancel at least 24 hours before.
• Cancelling. Cancel any time in your App Store or Google Play subscription settings; “Manage or cancel” in Hellodex takes you there. You keep Pro until the end of the period you’ve paid for. Deleting the app or your account doesn’t cancel billing.
• Refunds. Refunds are handled by Apple or Google under their policies; we can’t issue them directly.
• Price changes. We may change prices. Apple or Google will tell you before a change affects your subscription, as their rules require.
• When Pro ends. Nothing you’ve saved is deleted. You can keep viewing, editing and sharing it; adding and syncing need Pro again.

Promo codes

Promo codes give free Pro time for the period stated with the code. They have no cash value, can’t be resold or exchanged, can be used once per account, and may expire or be limited in number. Free time from a code doesn’t renew or charge you, and doesn’t pause a paid subscription. We may withdraw free time obtained by guessing, buying or otherwise misusing codes.

Other services

Hellodex relies on services from Apple, Google (including Firebase) and RevenueCat. Your use of the App Store or Google Play is also covered by their terms. We aren’t responsible for those services, but we choose providers with care; see the privacy policy for what each one does.

Ending your use

You can stop using Hellodex at any time and ask us to delete your account. We may suspend or close an account that seriously or repeatedly breaks these terms, or where the law requires it. Where we reasonably can, we’ll warn you first and give you a chance to export your contacts (for example by saving them to your phone). We may change or stop features, and if we ever shut Hellodex down, we’ll give you reasonable notice to save your contacts.

Disclaimers

We work hard to keep Hellodex reliable, but it is provided “as is” and “as available”. To the extent the law allows, we don’t promise that it will be uninterrupted or error-free, or that suggestions such as places or connections between people will always be accurate. Nothing in these terms limits rights you have under consumer law that can’t be waived.

Limits on liability

To the extent the law allows, we aren’t liable for indirect or consequential losses, such as lost profits, opportunities or data, and our total liability to you for any claim is limited to the greater of what you paid us for Hellodex in the 12 months before the claim, or USD 50. These limits don’t apply where the law doesn’t allow them, such as for death or personal injury caused by negligence, or fraud.

Governing law

These terms are governed by the laws of [state/country], and disputes will be handled in its courts, unless the law where you live gives you the right to use your local law or courts.

Additional terms for the App Store

If you downloaded Hellodex from Apple’s App Store, these terms also apply:

• These terms are between you and us, not Apple. We, not Apple, are responsible for Hellodex and its content.
• Your licence to use Hellodex is limited to Apple-branded devices you own or control, as allowed by the App Store’s usage rules.
• Apple has no obligation to provide maintenance or support for Hellodex.
• If Hellodex fails to meet an applicable warranty, you may notify Apple, and Apple will refund the purchase price, if any. To the extent the law allows, Apple has no other warranty obligation for Hellodex.
• We, not Apple, are responsible for handling claims about Hellodex, including product liability claims, claims that it fails to meet legal or regulatory requirements, consumer protection and privacy claims, and claims that it infringes someone’s intellectual property.
• You confirm that you aren’t located in a country subject to a U.S. Government embargo or designated as a “terrorist supporting” country, and aren’t on any U.S. Government list of prohibited or restricted parties.
• Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.

Changes to these terms

We may update these terms. We’ll change the date at the top, and for significant changes we’ll tell you in the app before they take effect. If you keep using Hellodex after that, the new terms apply; if you don’t agree, you can stop using it and delete your account.
